Chapter 5 - The Legal Battle Begins

The San Diego County Family Courthouse was an imposing building of marble and glass. I walked through the heavy double doors wearing a tailored navy suit I had borrowed from Clara, the nurse. Nancy was safely back at the hospital, guarded by a private security officer Jessica had hired pro bono.

Inside Courtroom 4B, Brandon sat at the plaintiff's table. He looked immaculate, projecting the aura of a wealthy, concerned father. Arthur Vance sat beside him, organizing pristine folders.

When I walked in with Jessica Hayes, Brandon didn't even look at me. He was too busy performing.

Judge Ramirez, a stern-faced woman with zero tolerance for courtroom theatrics, took the bench. "We are here for an emergency ex parte hearing regarding the custody of Nancy Simmons. Mr. Vance, your client is requesting immediate sole custody and a restraining order against the mother. That is a drastic measure. Make it quick."

Arthur Vance stood up, buttoning his suit jacket. "Your Honor, this is a tragic case of severe maternal negligence. Mrs. Simmons spends her days distracted by social media, completely ignoring her child. This gross negligence directly led to the horrific incident where the child ingested dangerous magnets. My client, a respected businessman, simply wants to protect his daughter from a dangerous environment."

Judge Ramirez looked at me. "Ms. Hayes? Your response?"

Jessica stood up slowly, a predatory smile playing on her lips. "Your Honor, opposing counsel’s narrative is certainly creative, but it belongs in the fiction section. We are submitting Exhibit A to the court."

Jessica handed a tablet to the bailiff, who passed it to the judge. "This is security footage from the marital home. It explicitly shows the petitioner’s mother, Evelyn Simmons—who is currently in county jail facing felony charges—intentionally feeding the child thirty-six high-powered magnets while Mrs. Simmons was upstairs doing household chores."

Brandon’s face twitched.

"We do not dispute Evelyn Simmons' deplorable actions, Your Honor," Vance quickly interjected. "But Mr. Simmons had no knowledge of—"

"Exhibit B," Jessica interrupted loudly, passing a thick binder to the bailiff. "Financial records, Your Honor. Mr. Simmons claims to be a responsible provider. These records show he has embezzled over two million dollars from his employer, accrued four million in offshore gambling debts, and is facing imminent federal indictment."

The courtroom was dead silent. Brandon gripped the edge of the table, his knuckles turning white.

"But the most compelling piece of evidence," Jessica continued, her voice echoing with righteous fury, "is Exhibit C. The Sterling Trust. A twelve-million-dollar fund designated for the minor child. A fund Mr. Simmons could only access if the child died, or if he secured sole custody and deemed the mother unfit."

Judge Ramirez flipped through the binder, her expression hardening into absolute disgust. She looked up and locked eyes with Brandon.

"Mr. Simmons," the judge said, her voice dripping with ice. "You froze your wife's bank accounts to starve her out of legal representation. You filed a frivolous custody petition to trigger a multi-million dollar payout to cover your gambling debts. And it appears highly likely you conspired with your mother to severely harm, if not kill, your own five-year-old daughter."

"That's a lie!" Brandon shouted, losing his composure completely. "She's a crazy bitch! She made this all up!"

"Bailiff," Judge Ramirez snapped. "Have Mr. Simmons seated and silent."

The heavy-set bailiff placed a firm hand on Brandon's shoulder, forcing him down.

"The emergency petition for custody is denied," Judge Ramirez declared, slamming her gavel. "Furthermore, I am granting Mrs. Simmons immediate, sole physical and legal custody. A permanent restraining order is issued against Brandon Simmons. And Ms. Hayes, I assume you have already forwarded this financial binder to the District Attorney?"

"Hand-delivered this morning, Your Honor," Jessica smirked.

I looked at Brandon. The arrogant, controlling man I had feared for years was gone. In his place was a pathetic, broken coward realizing his life was entirely over.
